These Terms of Use ("Terms") form a binding agreement between you and Motif. By downloading, accessing, or using the Motif application and related services (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

Please read carefully. Sections 4 through 9 limit Motif's liability, disclaim warranties, and require you to assume the risks of physical activity and of relying on the Service. Motif is a wellness and informational tool, not a medical service. Read these sections before relying on the Service.
You must be at least 16 years old, and old enough to form a binding contract where you live, to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate. You are responsible for your account and for activity that occurs under it.
Motif reads health and activity data from a wearable device or platform that you choose to connect, and generates scores, trends, and conversational coaching messages from that data. The coaching is produced in part by automated systems, including large language models, and is intended for general wellness, informational, and motivational purposes only.
Motif is not a healthcare provider, medical device, or substitute for professional care. The Service does not diagnose, treat, cure, monitor, or prevent any disease, condition, or injury, and is not intended to be relied upon for any medical or clinical purpose.
The Service does not provide medical advice. All content, scores, metrics, trends, and coaching messages are provided for general informational and wellness purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of a qualified physician or other health professional with any questions about your health, a medical condition, your recovery, or before starting, changing, or stopping any exercise, nutrition, sleep, or wellness program. Never disregard or delay seeking professional medical advice because of something you read or received in the Service.
Physical activity carries inherent risks, including the risk of serious injury, disability, or death. You understand that any exercise, training, recovery, or other activity you undertake in connection with the Service is undertaken voluntarily and at your own risk. You assume full responsibility for all risks, injuries, and losses that may result from your use of the Service or from any activity you choose to perform, and you agree that Motif is not responsible for them. You are solely responsible for evaluating whether any activity is appropriate and safe for you given your own health and physical condition.
The Service depends on data supplied by third-party devices, platforms, and providers, and on automated systems that interpret that data. This data and these outputs may be incomplete, delayed, unavailable, or inaccurate. Motif does not warrant the accuracy, reliability, completeness, or timeliness of any metric, score, trend, coaching message, or other output, and you should not rely on the Service as a precise or authoritative measure of your health. Your relationship with any connected third-party provider is governed by that provider's own terms and privacy policy.
The Service is provided "as is" and "as available," with all faults and without warranty of any kind. To the fullest extent permitted by applicable law, Motif disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranties arising out of course of dealing or usage of trade. Motif does not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any defect will be corrected, or that the Service will meet your requirements or produce any particular result.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by law.
To the fullest extent permitted by applicable law, in no event will Motif, its owners, affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, or for any personal injury, illness, or death, arising out of or relating to your access to or use of, or inability to use, the Service, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Motif has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, Motif's total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to Motif for the Service in the twelve months before the event giving rise to the claim, or twenty-five United States dollars (US$25).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You are solely responsible for your decisions and conduct while using the Service. To the fullest extent permitted by applicable law, you release Motif from any and all claims, demands, and damages of every kind arising out of or connected with your use of the Service, your reliance on any output of the Service, or any activity you perform in connection with it.
You agree to indemnify, defend, and hold harmless Motif and its owners, affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, your violation of any law or the rights of any third party, or any activity you undertake in connection with the Service.
Motif offers an optional paid subscription, Motif Pro. Purchases are processed by the Apple App Store and are subject to Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and you can manage or cancel them in your Apple ID settings. Refunds are handled by Apple in accordance with its policies.
You agree not to misuse the Service, including by attempting to access it by unauthorized means, interfering with its operation, reverse engineering it except where permitted by law, using it to violate any law, or relying on it in a manner inconsistent with these Terms. Motif may suspend or terminate your access if you violate these Terms.
The Service, including its software, design, text, graphics, and coach characters, is owned by Motif or its licensors and is protected by intellectual-property laws. Motif grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use, subject to these Terms.
Motif may modify the Service or these Terms at any time. When changes are material, we will update the "Last updated" date and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. You may stop using the Service at any time, and Motif may suspend or discontinue the Service, in whole or in part, at any time.
These Terms are governed by the laws of the jurisdiction in which Motif is established, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply. You agree that any dispute will be resolved in the courts of that jurisdiction, subject to any non-waivable right you have to bring proceedings in your local courts.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be applied to the maximum extent permitted by law. These Terms, together with the Privacy Policy, are the entire agreement between you and Motif regarding the Service.
